Article 1 | General
1.1. The General Terms and Conditions (hereinafter: Terms and Conditions) of BEYSTORES.COM apply to all offers, orders, agreements and deliveries of BEYSTORES.COM. By ordering, you indicate that you agree with these delivery conditions. These Conditions will be sent free of charge upon request.
1.2. It is only possible to deviate from the provisions of these Conditions in writing, in which case the other provisions remain in full force.
Article 2 | Agreement and Order
2.1. The agreement comes into effect when you place an order by clicking the 'Place order' button on the order form (the last form in the ordering process with product description and billing address). Bey Stores will then immediately process your order.
2.2. You will receive an email to the e-mail address you provided to confirm your order. In the unlikely event that you do not receive an email, your order is still valid.
2.3. BEYSTORES.COM does its best to show the images of the products as truthfully as possible. All images are indicative and are not binding on BEYSTORES.COM
2.4. The prices on BEYSTORES.COM are in euros and include 21% VAT. Bey Stores has the right to adjust its prices. The adjustments apply from the moment of publication on the website and are not valid for articles already ordered.
2.5. BEYSTORES.COM is entitled to refuse an order and / or to dissolve the agreement, if there are good grounds to believe that the other party will not (be able to) fulfill its obligations. If such a case occurs, BEYSTORES.COM will inform the other party of this within 14 (in words: fourteen) days after receipt of the order, with motivation.
Article 3 | Offers
3.1. All offers on BEYSTORES.COM are without obligation, unless stated otherwise. Bey Stores cannot be held to its offer if you could reasonably have understood that it was an obvious mistake or clerical error. You cannot subscribe to offers.
3.2. The prices stated on the Bey Stores website include VAT.
3.3. Discount codes, issued by BEYSTORES.COM, can be set to inactive at any time and without giving any reason.
Article 4 | Shipping costs
4.1. BEYSTORES.COM charges 5.95 euro shipping costs within the Netherlands. For orders over 100 euros and delivery within the Netherlands, BEYSTORES.COM does not charge shipping costs.
Article 5 | Delivery
5.1. BEYSTORES.COM strives to ship your order within the Netherlands within 24 hours of receipt of payment. At the latest, the article will be delivered within 3 working days after ordering. If this is not possible (for example because the order is temporarily out of stock) or if an order is not or only partially executed, you will receive a message as soon as possible after placing the order. In that case you have the right to cancel the order free of charge.
5.2. You are obliged to purchase the purchased products when they are made available to you.
5.3. If BEYSTORES.COM needs data from you for the execution of the agreement, the execution period does not start until you have made it available to BEYSTORES.COM correctly and completely.
Article 6 | Shipping & Transport
6.1. During the transport of the products, BEYSTORES.COM will take the risk in case of damage, theft or loss of the products. The risk passes to you at the time of delivery.
6.2. Bey Stores sends packages via the My Parcel parcel post service. The package or packages must be received in person.
6.3. The My Parcel delivery person will leave a notification in case of no answer (when you are not at home). The notification contains a 'Not at home' code. By logging in to www.My Parcel.nl/ontvangen and entering the code there, you can indicate when you want the package to be delivered. The exact instructions are on the note and on the My Parcel website.
Article 7 | Payment and Payment options
7.1. At BEYSTORES.COM you can choose from 8 (in words: eight) secure payment methods: iDeal, Mastercard, Visa, Maestro, American Express, Apple Pay, Google Pay and PayPal.
7.2. Payments with Mastercard, Visa, Maestro, American Express, Apple Pay and Google Pay are made via secure connections from Shopify.
7.3. If you choose the PayPal option for payment methods, your payment will be made via a secure connection at PayPal.
7.4. Bey Stores remains the full owner of all products delivered until the purchase price and any other amounts owed to BEYSTORES.COM have been fully paid.
Article 8 | Trial period
8.1. BEYSTORES.COM strives to ensure that all its customers are satisfied with their purchase from BEYSTORES.COM. If you are not satisfied with your purchase, you can return the goods, without giving reasons, within 14 (in words: fourteen) working days after receipt of the goods with the return label in your package.
You can cancel the agreement or exchange the articles. BEYSTORES.COM should be informed of this within 14 (in words: fourteen) working days via the contact form on the website, after which you fill in the return form. The return form is available for download on our website.
8.2. We charge costs for return by post of € 5.95.
8.3. Swimwear, lingerie and accessories cannot be returned by Bey Stores for hygienic reasons.
8.4. Returns, returns or exchanges are only possible if the article is in undamaged, packaged condition, has not been worn or washed and has the original and undamaged packaging and (info) cards. Bey Stores reserves the right to refuse returned items. However, this only happens if, in the opinion of BEYSTORES.COM, the article does not meet the above conditions.
8.7. If you cancel the agreement, you will receive all payments you have made up to that point, including delivery costs (with the exception of any additional costs resulting from your choice of a different method of delivery than the cheapest standard delivery offered by us) without delay and in any case, no later than 14 days after we have been informed of your decision to withdraw from the contract, back from us. We may withhold a refund until we have received the goods back or until you have demonstrated that you have returned the goods.
Article 9 | Liability
9.1. The liability of BEYSTORES.COM for direct or indirect damage, caused by an item purchased from it, is in any case limited to an amount equal to the sale price of the item, unless there is intent or gross negligence on the part of BEYSTORES.COM.
Article 10 | Force majeure
10.1. In this article, force majeure means: all shortcomings that BEYSTORES.COM cannot be blamed for.
10.2. In case of force majeure as a result of which BEYSTORES.COM cannot fulfill its obligations, the obligations will be suspended for a period of the force majeure situation. After 30 (in words: thirty) days, both parties have the right to dissolve the agreement in whole or in part by means of a written statement, without the right to any (damage) compensation.
Article 11 | Guarantee
11.1. BEYSTORES.COM guarantees that the items to be delivered by us meet the usual requirements and standards that can reasonably be set at the time of delivery and for which we are intended for normal use in the Netherlands. When used outside the Netherlands, you must verify whether the use of the article is suitable for use there.
11.2. You must examine the delivered items at the time of delivery, and in any case within the set trial period. In doing so, you should investigate whether the quality and quantity of the delivered goods correspond with what has been agreed, or at least meet the requirements that apply to them in normal (trade) traffic.
11.3. After expiry of the warranty period referred to in article 8.1, Bey Stores is entitled to charge all costs for repair or replacement, including administration, shipping and call-out costs.
11.4. The warranty referred to in this article will lapse if the defect has arisen as a result of injudicious or improper use or if, without written permission from BEYSTORES.COM, you or third parties have made changes or attempted to make changes to the product or this have used it for purposes for which the product is not intended.
Article 12 | Disputes
12.1. All legal relationships to which BEYSTORES.COM is a party are exclusively governed by Dutch law, even if an obligation is fully or partially implemented abroad or if the party involved in the legal relationship is domiciled there. The applicability of the Vienna Sales Convention is excluded.
12.2. BEYSTORES.COM will always try to resolve a complaint in consultation with you. If a joint solution cannot be found, a dispute must be submitted by the most diligent party to the competent court in the district of Amsterdam.
Article 13 | Copyright photos and images
13.1. All photos and images displayed on BEYSTORES.COM are copyrighted, regardless of how they are distributed or the form in which they are delivered. Without written permission from BEYSTORES.COM, the photos and images may not be published or reproduced in any way.
13.2. If you do use any photo or image without the prior written consent of BEYSTORES.COM, you will be ordered to cease use and a claim will be made to you.
